2.    What personal information does DigiKey collect and why?

The personal information that we may collect about you broadly falls into the following categories:

For example, we may ask you to provide your contact details in order to register an account with us, to fulfill an order you place with us, to subscribe to our newsletters or other marketing communications from us, and/or to submit inquiries to us. We collect information you provide when you enter a contest, sweepstakes, or other promotions, when you request stock notifications and product availability information, when you complete a survey, when you sign up for a webinar or other event we host or sponsor, or when you send us an email or feedback. If you provide us with your email address, we may use it to send you transactional and marketing communications, and you always have the option to opt out of marketing communications. We also collect your credit card information or other financial details when you make a purchase with us.

If you leave comments on the website, information associated with that comment, such as your username and the time of the post, may be saved. If the website allows users to publicly post submissions and you decide to publicly post a submission on the website, your name may appear on the website in connection with your submission.

Chat: Information is collected from our online customer support chat service (such as your chat login details or other personal information and chat communications, which we monitor for quality assurance purposes). Chat communications are recorded and use third-party cookies, and DigiKey’s chat service provider may have access to or store chat communications and related information.

Phone calls: DigiKey and its service providers providing services to DigiKey, may monitor and record phone calls (and other correspondence with DigiKey, such as emails, chat conversations, and communications) to assess the customer service being provided. Recordings may be shared with and stored by DigiKey’s service providers for these purposes. In addition, personal information collected through call recordings may be used in connection with artificial intelligence (AI) tools and technologies, including for transcription, quality monitoring, and service improvement purposes. For more information about DigiKey's use of AI, see the paragraph below regarding AI models and tools.

The personal information that you are asked to provide, and the reasons why you are asked to provide it, will be made clear to you at the point we ask you to provide your personal information (unless it is obvious from the context).

  • Information that we collect automatically
  • We and our third-party service providers or partners may collect certain information automatically from your device when you visit our website or use any services we provide. Collecting this information provides a better understanding of the visitors who come to our website, where they come from, and what content on our website is of interest to them. This information is used for our internal analytics purposes, to improve the quality and relevance of our website and services to our visitors, and to enhance the security of our website. We may also create customer profiles based on aggregated or individual information to better understand needs and preferences, enhance products and services, and inform relevant marketing or advertising. Some of this information is necessary for the proper functioning of the website and may be collected using cookies and similar tracking technology, as explained further under the heading "Cookies and similar tracking technology" below.

We may use personal information to develop, train, update, and fine-tune internal artificial intelligence (AI) models and tools operated solely by or for DigiKey. These internal tools are used to support and improve DigiKey’s operations, including improving services and supporting business processes.

In addition to collecting personal information for the purposes outlined in this Privacy Notice, we may use personal information for other compatible purposes including, without limitation, anonymizing or de-identifying data (which may be done by DigiKey or its service providers). • From time to time, we may receive personal information about you from third-party sources. These sources may include media partners, webinar partners, and event partners who share your contact information with us when you register for joint events or activities, as well as suppliers and authorized resellers who provide information necessary to process orders, engage in compliance, or support customer service.

We may also obtain aggregated information, including analytical results, about your use of the website for fraud detection, prevention, and reporting purposes.

3.    Who does DigiKey share my personal information with?

We may disclose your personal information to the following categories of recipients:

  • to our related companies and third-party suppliers, manufacturer representatives, partners, and service providers, as well as other companies (such as delivery services or couriers) in connection with the shipment or delivery of products. For example, we may disclose personal information to one or more of the above parties to support the delivery or drop shipment of products ordered, for order fulfillment purposes, for purposes of securing pricing, for legal compliance purposes, for export and trade compliance, for duty drawback purposes, for providing customer support (including through chat, phone, and email communications), working with customers on design registration, assessing product availability, and other issues concerning products, to provide functionality on, help to enhance, or increase the security of our website and services, to provide advertising services and web analytics, for market research purposes, or to a third party who assists us with a contest, sweepstakes, other promotions, surveys, webinars, or events. We also may disclose personal information to those who otherwise process personal information for purposes that are described in this Privacy Notice or who you are notified about when we collect your personal information.   • to partners that organize or co-sponsor events or webinars. If you use our site to register for an event or webinar, we may share your personal information with the relevant partner to process your registration and facilitate your participation. In these cases, the partner will process your personal information as an independent controller, and their use of your personal information will be governed by their own privacy notice and policies;
  • to any competent law enforcement body, regulatory body, government agency, court or other third party where we believe disclosure is necessary (i) as a matter of applicable law or regulation, (ii) to exercise, establish or defend our legal rights, (iii) as part of a lawsuit or investigation, or (iv) to protect your vital interests or those of any other person;

4.    Legal basis for processing, if applicable to you

However, we will normally collect personal information from you only (i) where we need the personal information to perform a contract with or provide a service to you, (ii) where the processing is in our legitimate interests and not overridden by your rights, (iii) where we have a legal obligation to do so, or (iv) where we have obtained your consent.

If you have questions about or need further information concerning the legal basis on which we collect and use your personal information, please contact us using the contact details provided under the "How to contact us" heading below.

5.    Cookies, similar tracking technology, targeted advertising, and third-party service providers

We use first- and third-party technologies such as cookies, web beacons, pixel tags, and similar tracking technology (collectively, "Cookies") to collect and use personal information about you, including to facilitate site navigation, to better understand and improve our services, to inform us of your interactions with our websites (including clicks, cursor movements, and screen recordings), and to serve targeted advertising, interest-based advertising, and cross-context behavioral advertising (generally referred to as "Targeted Ads" and "Targeted Advertising"). For further information about the types of Cookies we use, why, and how you can control Cookies, please see our Cookie Notice and Privacy Preference Center.

We may use your personal information to facilitate the delivery of Targeted Ads. You may opt out of our sharing of personal information for Targeted Advertising, as defined under applicable law, by submitting a request to DigiKey. See "Right to Opt-Out of the Sale of Your Personal Information or Sharing of Personal Information for Targeted Advertising" below.

We may use a variety of third-party services to help provide our website and services, such as developing and hosting our website, and to help us understand the use of our website, such as Google Analytics, to provide information to us and to provide you with advertising regarding our website and our products and services. We may also collect or otherwise gather information related to you from these third-party service providers. These third-party service providers may collect, store, and share information as further dictated by their own privacy policies.

Google, Inc., may utilize the data collected to track and examine the use of our website, to prepare reports on its activities and share them with other Google, Inc. services. Google, Inc. may also use the data collected to contextualize and personalize the ads of its own advertising network to serve ads to you based on your visit to our website and other sites on the Internet. You may view Google's privacy policy here: https://policies.google.com/privacy?hl=en, with more information located here: https://www.google.com/policies/privacy/partners/ (including information regarding how to control how information is shared through your Ads Settings) and here: https://support.google.com/analytics/answer/6004245?hl=en.

You can prevent the collection of the data generated by Google Analytics in relation to your use of our website and the processing of this data by downloading and installing the Google Analytics Opt-out Browser Add-on, with more information regarding how you can opt out of Google Analytics data collection available here: https://tools.google.com/dlpage/gaoptout. This link provides instructions for installing an opt-out add-on on your device. As a result, the collection of data by Google Analytics is prevented in the future for the website and for your browser as long as the opt-out add-on remains installed in your browser.

Facebook similarly provides more information regarding the information it collects and how it is used in relation to advertising along with methods to opt out of the collecting and sharing of information here: https://www.facebook.com/settings?tab=ads; and https://www.facebook.com/policy.php.

6.    How does DigiKey keep my personal information secure?

We use appropriate technical and organizational measures to protect the personal information that we collect and process about you. The measures we use are designed to provide a level of security appropriate to the risk of processing your personal information. In particular, DigiKey's website is equipped with Transport Layer Security (TLS) technology. Online orders to DigiKey can only be placed from a browser that supports TLS. Where this is the case, your browser will automatically enter a secure mode when you make purchases. If your browser does not support TLS or you would like to place orders using a method other than the website, please review the "Ordering FAQs" section of our website for alternative ordering methods.

If you would like to report a concern about our website, please email us at security@digikey.com.

7.    International data transfers

Your personal information may be transferred to, and processed in, countries other than the country in which you are a resident. Specifically, our website servers are located in the U.S., and our group companies and third-party service providers and partners operate around the world. This means that when we collect your personal information we may process it in any of the countries where we or our service providers operate.

We have taken appropriate safeguards to require that your personal information will remain protected in accordance with this Privacy Notice. These include implementing the European Commission and UK Standard Contractual Clauses where appropriate, which can be provided on request. We may also utilize addendums and other data transfer agreements specific to certain countries as required. We have implemented similar appropriate safeguards with our third-party service providers and partners and further details can also be provided upon request.

8.    Data retention

The length of time we retain personal information will be determined based upon criteria such as: the length of time your personal information remains relevant; the length of time it is reasonable to keep records to demonstrate that we have fulfilled our duties and obligations; any limitation periods within which claims might be made; any retention periods prescribed by law or recommended by regulators; or the type of contract we have with you, the existence of your consent, and our legitimate interest or business need in keeping such information (for example, to provide you with a service you have requested or to comply with applicable legal, tax, compliance, or accounting requirements).

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it or, if this is not possible (for example, because your personal information has been stored in backup archives), we will securely store your personal information and isolate it from any further processing until deletion is possible.

9.    Automated decision-making

In some instances, our use of your personal information may result in automated decisions being made that legally affect you or similarly significantly affect you.

Automated decisions mean that a decision concerning you is made automatically on the basis of a computer determination (using software algorithms), without meaningful human review. For example, we use automated decisions to protect against fraudulent transactions. We have implemented measures to safeguard the rights and interests of individuals whose personal information is subject to automated decision-making, including limiting the use of automated procedures to fraud detection and providing a means to contact DigiKey if needed.

When we make an automated decision about you that legally affects you or has a significant effect on you, you may request a human review of the decision. You can exercise this right by contacting us using the details provided in this notice.

10.    Your data protection rights (see also Section 15 below)

You may have the following data protection rights depending on your location:

  • If you wish to access, confirm our processing of, correct, update, or request deletion or anonymization of your personal information, you can do so at any time by contacting us using the contact details provided under the "How to contact us" heading below.
  • You may have the right to object to processing of your personal information, ask us to restrict processing of your personal information or request portability of your personal information. Again, you can exercise these rights by contacting us using the contact details provided under the "How to contact us" heading below.
  • You may have the right to opt-out of certain uses of your personal information, including: the sale or sharing of your personal information; the use of your personal information for targeted advertising; and profiling in furtherance of automated decisions that produce legal or similarly significant effects. You can exercise these rights by contacting us using the contact details provided under the "How to contact us" heading below or, where applicable, through any opt-out mechanisms we make available.
  • You may also have the right to obtain a list of the specific third parties to whom we have disclosed your personal information.
  • You have the right to opt-out of marketing communications we send you at any time. You can exercise this right by clicking on the "unsubscribe" or "opt-out" link in the marketing e-mails we send you. To opt out of other forms of marketing (such as postal marketing or telemarketing), please contact us using the contact details provided under the "How to contact us" heading below.
  • Similarly, if we have collected and processed your personal information with your consent, then you can withdraw your consent at any time. Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect processing of your personal information conducted in reliance on lawful processing grounds other than consent.
  • You may also have the right to know about and opt-out of our use of automated decision-making technology in furtherance of decisions that produce legal or similarly significant effects. You can exercise these rights by contacting us using the contact details provided under the "Exercise Your Privacy Rights" section below.
  • If we decline to take action on a request you have submitted, you have the right to appeal our decision. Instructions for submitting an appeal are in Section 15.
  • You may have the right to complain to a data protection authority about our collection and use of your personal information. For more information, please contact your local data protection authority. Contact details for data protection authorities in the European Economic Area are available here. We will not discriminate or retaliate against you for exercising any of your data protection rights.

We respond to all requests we receive from individuals, or their authorized representatives if permitted by applicable law, wishing to exercise their data protection rights in accordance with applicable data protection laws.

11.    Children

The website is not intended to solicit, collect or process personal information from any individual under the age of 16. If you are a parent or guardian, please contact us if you believe information regarding a child has been collected by us through our website.

12.    Do not track

Presently the website does not honor "do not track" settings on web browsers and does not offer you the opportunity to request that we not track your use of its services.

13.    Processing opt-out requests via universal opt-out mechanisms

We honor opt-out requests submitted through recognized universal opt-out mechanisms, such as the Global Privacy Control ("GPC"), as required by applicable privacy laws. When we detect a valid opt-out signal, we treat it as a request to opt out of the sale or sharing of personal information for Targeted Advertising. These signals are applied on a per-browser and per-device basis because they operate through cookies stored on your device. The signal controls Targeted Advertising activities conducted through digital touchpoints involving cookies and similar online identifiers and does not apply to offline data sharing. The signal may not be effective if you switch to a new browser or device, or if you clear your cookies or cache; however, if you continue using a browser or extension that sends these signals, a new signal will be sent automatically. There is no expiration for the opt-out signal. To send an opt-out signal, you must use a web browser or browser extension that supports and is configured to send such signals, which will automatically transmit the signal on your behalf when you visit our website.

14.    Third party websites

The DigiKey website may contain links to other websites. DigiKey cannot take responsibility for personal information collected on these third-party websites, nor does DigiKey monitor or accept responsibility for the accuracy or content of these other websites.

15.    Additional rights regarding your personal information

If you are located in certain jurisdictions, you may have specific rights under applicable data protection laws regarding your personal information, which may include, subject to certain conditions and exceptions:
